Flour war spills into  court

BULAWAYO-BASED wholesaler Bulk Commodities is suing a local bakery, Double Fresh for more than $30 000 for allegedly failing to pay for flour supplied over the past few months as the row between the two companies has spilled into the courts.

Bulk Commodities, through their lawyers, Phulu and Ncube on Monday filed summons at the Bulawayo High Court citing Dial Direct, which trades as Double Fresh Bakery as the defendant.

According to the summons, Bulk Commodities is demanding $23 709,30 for goods (flour) supplied to Double Fresh which has not been settled despite demand. It is also claiming interest of five percent per annum calculated from the date of summons and for the bakery to meet the cost of suit.

Further, Bulk Commodities is also demanding that Double Fresh pay $7 000 for an RTGS payment for flour supplied which supposedly was not paid in spite of another demand. The company also faces a similar legal case from Agriswiss Zimbabwe.

The latest developments follow allegations by Double Fresh that it lost more than $18 000 in potential revenue after it was supplied with sub-standard flour by Bulk Commodities.

Double Fresh managing director Mr Mnothisi Nsingo yesterday said his company was, infact, the first to seek legal recourse after being supplied with contaminated flour and said his legal team was defending both cases in court.

“We demanded $200 000 from Bulk Commodities after they supplied us with contaminated flour in a very documented case.

We also defended our case against Agriswiss after we were not happy with their service. The truth of the matter is we are victims here. I also want to make it clear that we have since changed flour suppliers and our bread is now perfect,” he said.
