AN inmate at Bulawayo Prison  has been dragged to court for an alleged act of misconduct after he ejaculated on the legs of a fellow intimate while they were asleep.

Brendon Moyo (24) of Njube last week appeared before Bulawayo magistrate Ms Nomasiko Ndlovu, charged with indecent assault as defined in section 67 of the criminal law codification and reform act chapter 9:23.

He was however, lucky to be found not guilty after he argued that he did not intentionally do the misconduct as it was a result of a wet dream.

The magistrate said there was no evidence that he inserted his privates between the thighs of the fellow inmate intentionally.

Ms Ndlovu said it might be possible it was wet dreams and wet dreams happen when someone is asleep and not aware of what is happening to them.

However, according to prosecutor Ms Siphiwe Mhlanga, on 11 November last year Moyo and other intimates were in Cell 7 when another inmate was also placed in the cell after he was convicted by the court.

The court heard that at night Moyo went to the new intimate and told him to come sleep next to him as the other side was crowded.

The court heard that the new inmate complied but during the night he felt Moyo touch his lower part of his waist and he ignored him thinking it was a matter of overcrowding.

The court heard that around 3am Moyo allegedly inserted his privates between the new inmate’s legs and ejaculated.  The inmate told other inmates who informed a prison officer leading to the arrest of Moyo. – Angel Nkomo.
