OFFENCE: CONTRAVENING OF SECTION 5 (3) (a) – AS SECTION OF THE FOOTBALL ETIQUETTE ACT CHAPTER (5:16) (SCORING FROM AN OFFSIDE POSITION)
AND SECTION 5 (6) (c) – AS SECTION OF THE FOOTBALL ETIQUETTE ACT CHAPTER (5:22) (ASSAULT WITH INTENT TO CAUSE GRIEVOUS BODILY HARM)

OUTLINE OF THE STATE CASE
-The accused is a Cameroonian adult male playing for Dynamos Football Club in Harare. He is aged 24 and has no respect for football.

-The complainants are the owners of the game of football, the supporters, residing in Zimbabwe.

-The accused is footballer and the complainants pay their hard earned money to watch the accused and his colleagues play the beautiful game of football.

-On the 14th day of May, 2017 the accused and the complainant were at Barbourfields Stadium in Bulawayo. The accused was playing for Harare side Dynamos against Highlanders in a Premier Soccer League encounter. In the 40th minute the accused contrived to score a goal from an offside position causing the abandonment of the fixture after the complainant refused to accept the validity of the “goal”.

-On the 10th day of September, 2017 the accused and the complainant were at Rufaro Stadium in Harare. The accused was playing for Harare side Dynamos against Highlanders in a Premier Soccer League encounter. In the 87th minute the accused physically assaulted Highlanders player Peter Muduhwa by head butting him on the left cheek.

-The accused had no lawful right to act violently towards Muduhwa or to score from an offside position.

AND SECTION 5 (6) (c) – AS SECTION OF THE FOOTBALL ETIQUETTE ACT CHAPTER (5:22) (ASSAULT WITH INTENT TO CAUSE GRIVOUS BODILY HARM)

Sentence: Apology to Zimbabwean football lovers. In default, a summary judgment of deportation back to Cameroon will be enforced.
