Msipa files $5m lawsuit against MP Matambanadzo

ZANU-PF secretary for security for Kushinga District in Kwekwe Cde Marco Msipa, who recently lost his right eye after he was allegedly assaulted by Kwekwe Central legislator Cde Masango Matambanadzo and his bodyguard, has filed a $5 million lawsuit against the two.Cde Msipa filed the lawsuit at the Bulawayo High Court through his lawyer Mr Valentine Mutatu of Mutatu and Partners legal practitioners, claiming damages for injuries sustained due to the assault.

In the lawsuit seen by Sunday News, Cde Msipa is demanding compensation from Cde Matambanadzo and his bodyguard Mr Burden Mawire after he lost an eye as a result of the assault.

Cde Matambanadzo was served with the papers last Friday afternoon.

Cde Msipa alleges that he was assaulted by the lawmaker and his bodyguard at Amaveni Shopping Centre in Kwekwe.

“On 11 August 2014, and at Kwekwe, defendants unlawfully assaulted the plaintiff with fists on his head, face and all over the body. The defendants also hit the plaintiff against the wall of the building they were in. As a result of the assault, the plaintiff had to undergo medical treatment for injuries sustained on his head and injuries on his face, particularly his eye, which has been confirmed to have gone 100 percent blind.

“He was unable to work for his family and consequently suffered loss of income. He also had pain and suffering,” read the papers in part.

Cde Msipa, who also suffered contumelia, is claiming a total of $5 million in medical bills and damages.

“As a result of the foregoing proof he suffered the following damages, permanent blindness $2 million, pain and suffering $2 million, loss of contumelia $1 million and medical expenses $1 500,” reads the   lawsuit.

Cde Matambanadzo is also facing charges of assaulting Gokwe-Kana MP Cde Owen Ncube after he allegedly attacked him at the same business centre following a misunderstanding.
