A 40-YEAR-OLD Bulawayo man will spend the next 10 years in jail for sodomising his workmate in the middle of the night while he was asleep. Mthandazo Mathe of Sizinda pleaded not guilty to charges of aggravated indecent assault when he appeared before Gwanda regional magistrate Joseph Mabeza.
However, due to overwhelming evidence, Mathe was yesterday convicted and sentenced to 10 years imprisonment for sodomising his 34-year-old workmate who cannot be named to protect his dignity.
The two were working together at a mine in Matobo District.
Regional prosecutor Johannes Tlou narrated how Mathe quenched his sexual desires on his workmate who was fast asleep and threatened to kill him if he dared to resist.
“On 27 November, 2014, and at around midnight, the accused person Mthandazo Mathe noticed that the complainant was fast asleep and sneaked into his blankets and had anal sexual intercourse with him.
“The complainant woke up and noticed that the accused person’s privates were inserted into his anus and was threatened with death if he divulged the information to anyone,” the court heard.
Fearing for his life, the complainant gave in and let Mathe get the sexual satisfaction he wanted from him.
The matter came to light after another workmate asked the complainant why he looked unhappy and he revealed his ordeal and the threats made against him by Mathe.
The complainant’s workmate who was informed of the matter, in turn made a report to the police leading to the arrest of Mathe.
The complainant was referred to the United Bulawayo Hospitals for medical examination.
