A Kwekwe woman is lucky to be alive after her husband stabbed her with a knife in a bid to force her out of their matrimonial home for testing HIV positive.
Ms Mary Henyenya of Mbizo told a Kwekwe magistrate when she applied for a protection order against her husband, Jima Nyongo that she survived a knife attack from him when he was trying to push her out of their matrimonial home for testing HIV positive.
She said the situation had turned nasty ever since she tested positive to HIV that the man at one time stabbed her with a knife saying he could no longer live with her.
“He once stabbed me with a knife and I ran away. I am now staying at our go-between’s homestead as I fear for my life. He has become violent and I am afraid that he might kill me,” Ms Henyenya told magistrate Mr Story Rushambwa.
The complainant also accused her husband of stigmatising her through spreading her status in the community.
However, Nyongo through his lawyer Mr Liberty Mashanyare of Mashanyare Legal Practitioners said the woman was simply failing to stomach the fact that her husband was no longer interested in the marriage and wants a divorce.
“She is refusing to accept a token of divorce that has been given to her several times. My client has nothing to do with her anymore but she is refusing to heed the call,” said Mr Mashanyare.
He argued that the matter was not being spread as insinuated by Ms Henyenya but the defendant had no option but to tell the relatives who wanted to know the reasons for the divorce.
“Both parties’ relatives wanted to know what she was suffering from since she was bedridden at the time. The matter therefore became an open secret as both parties wanted to know,” Mr Mashanyare said.
He went on to apply for a binding protection order which the magistrate granted.
“When your husband has clearly declared in a public court that he no longer loves you, why do you have to cling onto him? It is clear that the marriage has irretrievably broken down. The court therefore grants the binding order by consent,” said Mr Rushambwa.
