Man claims $9k from adulterous wife’s boyfriend

A Kwekwe man whose wife of 10 years is allegedly having an adulterous affair with his close friend has approached the courts seeking $9 000 as compensation from the alleged boyfriend.

Mr Gerald Ganga of 2369/11 in Mbizo, claims that Mr Linos Maswera of 19870/9 also in Mbizo, is having an affair with his wife of 10 years Moreblessing Maphosa and is claiming compensation for the “mess” he has caused in his family.

According to court papers submitted before Kwekwe magistrate Mr Story Rushambwa, Mr Ganga was alarmed by the news doing rounds in the neighbourhood indicating his wife was having an extra marital affair with the defendant.

On confronting his wife, she allegedly confessed that she has been cheating with Mr Maswera for the past three years and receiving money via EcoCash.

Mr Ganga raised the matter with his family who then decided the defendant should pay compensation instead of pursuing the matter further since the two are close associates.

Mr Maswera was, however, not forthcoming resulting in Mr Ganga seeking legal recourse in resolving the matter.

In his application, Mr Ganga claims the matter has caused him injuries, personal humiliation, sleep disturbances, mental anguish and sexual dysfunction among other damages hence the compensation totalling $9 000.

In opposing, Mr Maswera said Mr Ganga should pay him for time wasting since he did not have any evidence that he indeed was dating his wife.

“The legal terms for such claims is frivolous and vexatious and should not be entertained by the court. Wherefore, plaintiff prays for judgment in terms of the particulars of claim filed record and dismiss the matter with costs,” wrote Mr Maswera.

Magistrate Rushambwa deferred the matter to 12 December.
